LEGAL NOTICE: These Terms & Conditions have been drafted with reference to the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Electronic Transactions Act 1999 (Cth), and general contract law principles. They are intended as a strong legal foundation and should be reviewed by a qualified Australian solicitor before publication, particularly in relation to membership terms and refund obligations.

These Terms and Conditions ("Terms") govern your access to and use of the Audacious Woman website located at audaciouswoman.com.au and the Founders Club membership platform ("Platform"), operated by Victoria Therese Jackson (ABN 35 488 745 369), trading as Audacious Woman and TVA Consultancy Group ("we", "us", "our").
By accessing our website, registering for any free or paid product, or becoming a member of the Founders Club, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
These Terms constitute a legally binding agreement between you and us. Please read them carefully.
2. our services
We provide the following services through our website and platform:
Free lead magnets and resources (e.g., CEO Score Quiz, Ops Audit, Founder's Sanity Checklist)
Paid digital products and courses (including The Retention Blueprint and Foundation Formula)
The Founders Club membership program, offered at three tiers: Member, Inner Circle, and Boardroom
Business systems consulting, strategy, and advisory content
Educational content via The Founders Project podcast and newsletter
The nature, scope, and pricing of our services may change over time. We will provide reasonable notice of material changes to existing members.
3. eligibility
By using our website or purchasing our services, you represent and warrant that:
You are at least 18 years of age
You have the legal capacity to enter into a binding agreement
You are accessing our services for lawful, business-related purposes
All information you provide to us is accurate and complete
Our services are intended for business owners, consultants, coaches, and service-based professionals. They are not intended as personal, financial, or legal advice.
4. accounts and registration
To access certain areas of our website and the Founders Club platform, you must create an account. You agree to:
Provide accurate, current, and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorised use of your account
Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect have been compromised.
5. founders club membership
5.1 MEMBERSHIP TIERS AND PRICING
The Founders Club is offered at the following tiers (prices current at the date of these Terms and subject to change):
All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
5.2 MINIMUM COMMITMENT PERIOD
By joining the Founders Club, you commit to a minimum membership period of six (6) consecutive months at your chosen tier ("Minimum Commitment Period"). You acknowledge and agree that:
Payment will be charged monthly via Stripe on or around your join date
You will not be entitled to cancel your membership or cease payment during the Minimum Commitment Period, except where required by Australian Consumer Law
After the Minimum Commitment Period, your membership will continue on a month-to-month basis until cancelled in accordance with clause 5.4
Failure to pay during the Minimum Commitment Period may result in debt recovery action and suspension of access
5.3 BILLING AND PAYMENT
By purchasing a Founders Club membership, you authorise us to charge your nominated payment method on a recurring monthly basis. You agree to:
Keep your payment details current and accurate
Notify us immediately of any changes to your payment method
Accept responsibility for all charges incurred under your account
Payments are processed by Stripe. We do not store your card details. Failed payments will be retried in accordance with Stripe's standard retry schedule. If payment continues to fail, your access may be suspended until payment is resolved.
5.4 CANCELLATION
After the Minimum Commitment Period, you may cancel your membership at any time by providing written notice to hello@audaciouswoman.com.au at least 7 days before your next billing date. Cancellations received after this window will take effect from the following billing cycle.
Upon cancellation, your access to the platform will continue until the end of your paid billing period. No partial refunds will be issued for unused time within a billing period, except where required by Australian Consumer Law.
5.5 PRICE CHANGES
We reserve the right to change membership pricing with a minimum of 30 days written notice to existing members. If you do not accept the new pricing, you may cancel your membership before the change takes effect without penalty (subject to the Minimum Commitment Period having been completed).
6. REFUND POLICY
6.1 DIGITAL PRODUCTS AND COURSES
Due to the digital nature of our products, we generally do not offer refunds once access has been granted or the product downloaded. By purchasing, you acknowledge and accept this condition.
However, we will offer a refund in the following circumstances:
The product or service was not as described or is defective
You are entitled to a remedy under the Australian Consumer Law
We have agreed to a refund in writing prior to or at the time of purchase
6.2 MEMBERSHIP REFUNDS
Membership fees paid during the Minimum Commitment Period are non-refundable, except where required under Australian Consumer Law. This is because access to the platform, community, and content library is provided immediately upon payment.
6.3 AUSTRALIAN CONSUMER LAW
Nothing in these Terms limits, excludes, or modifies any rights you have under the Australian Consumer Law, including your right to a repair, replacement, or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
7. INTELLECTUAL PROPERTY
7.1 OUR CONTENT
All content published on our website and platform — including but not limited to course materials, frameworks (including the DELIVER Framework™), templates, worksheets, graphics, copy, podcast episodes, and newsletters — is owned by or licensed to Victoria Therese Jackson and is protected by copyright law.
You may not copy, reproduce, distribute, sell, modify, or create derivative works from our content without our express written permission. This prohibition extends to sharing login credentials or platform access with non-members.
7.2 YOUR CONTENT
You retain ownership of any content you submit to the platform (posts, comments, uploaded materials). By submitting content, you grant us a non-exclusive, royalty-free licence to display, share (within the platform), and use that content for the purpose of providing and improving our services.
You warrant that any content you submit does not infringe the intellectual property rights of any third party and does not violate any applicable law.
7.3 FEEDBACK
If you provide us with feedback, testimonials, or suggestions, you grant us the right to use and publish this content for marketing and business purposes, with attribution to your first name and business name unless you request otherwise.
8. ACCEPTABLE USE
You agree not to use our website or platform to:
Violate any applicable law or regulation
Infringe the intellectual property rights of us or any third party
Share, distribute, or resell our paid content to non-members
Harass, abuse, or harm other members of the community
Submit false, misleading, or fraudulent information
Attempt to gain unauthorised access to our systems or other accounts
Upload content that contains malware, spam, or harmful code
Use our platform for any purpose that competes with our business without our prior written consent
We reserve the right to suspend or terminate your access without refund if you breach this clause or any other provision of these Terms.
9. DISCLAIMER OF WARRANTIES
Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, regarding:
The accuracy, completeness, or suitability of the content on our website or platform
That our services will meet your specific business outcomes or financial results
That our website or platform will be uninterrupted, error-free, or free from viruses
Our content and programs are for educational and informational purposes. They do not constitute legal, financial, accounting, or professional advice. You should seek independent professional advice before making business or financial decisions.
10. LIMITATION OF LIABILITY

Our services rely on third-party platforms including Ivorey, Stripe, and others. We are not liable for any outages, data loss, or errors caused by these platforms. We will make reasonable efforts to communicate any known platform disruptions to affected members.
12. COMMUNITY STANDARDS
The Founders Club community is a professional, supportive environment for female founders and service-based business owners. By joining, you agree to:
Engage respectfully with other members and with us
Refrain from soliciting, promoting, or selling your own products or services to other members without our express consent
Maintain the confidentiality of information shared by other members
Uphold the integrity and professional tone of the community
Breach of community standards may result in removal from the platform without refund.
13. GOVERNING LAW & JURISDICATION
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

14. Changes to These Terms
We reserve the right to update these Terms at any time. We will provide reasonable notice of material changes via email or a notice on our website. Your continued use of our website or platform following notice of changes constitutes your acceptance of the updated Terms.
For significant changes to membership terms, we will provide a minimum of 30 days notice.
15. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of our website and services. They supersede all prior agreements, representations, and understandings.
